End-User License Agreement (EULA)

1. Definitions

• Platform: The websites, mobile applications, and services operated by Volatil3 Technologies for the sale and distribution of Digital Goods.
• Digital Goods: In-game currencies, top-ups, vouchers, gift cards, prepaid codes, and other virtual gaming-related content made available through the Platform.
• User Account: A registered account that provides access to the Platform and transactions.
• Top-Up: A transaction where credits or in-game currency are applied to a User's designated game account.
• Third-Party Services: Services provided by external entities, including game publishers, payment processors, and distributors.
• User Content: Any content submitted by Users (feedback, comments, reviews, etc.).
• Effective Date: The date you first accept this EULA or use the Platform.

2. License Grant

• Subject to this EULA, Volatil3 grants you a personal, limited, non-exclusive, non-transferable, revocable license to use the Platform and access Digital Goods solely for personal, non-commercial purposes.
• All Digital Goods are licensed, not sold. You acquire only a limited right to use such goods under this Agreement and the terms of the applicable game publisher.
• You have no ownership rights in Digital Goods. They remain the property of Volatil3 or its licensors.
• Any use of the Platform or Digital Goods in violation of this Agreement terminates your license immediately.

3. User Obligations

3.1 Eligibility

You must be at least 18 years of age or have the consent of a parent/legal guardian.

3.2 Account Security

You are responsible for safeguarding your User Account and all activity under it.

3.3 Accuracy of Information

You must provide truthful, current, and complete information when registering.

3.4 Prohibited Conduct

You agree not to engage in prohibited activities as outlined in this agreement.

4. Digital Goods Disclaimer

• Digital Goods have no intrinsic monetary value outside their intended use within the specified game or platform.
• Purchases of Digital Goods are final, non-refundable, and non-transferable, except where required by law or under our Refund Policy.
• Digital Goods may expire, change, or be removed at the discretion of Volatil3 or third-party publishers.
• Volatil3 is not responsible for the loss of Digital Goods due to account bans, publisher decisions, or technical failures outside our control.

5. Payments, Transactions, Refunds & Cancellations

• Pricing: All prices are displayed in Indian Rupees (INR) and inclusive of applicable taxes, unless otherwise stated.
• Finality of Sales: All purchases of Digital Goods are final, non-refundable, and non-exchangeable, except as required under applicable law.
• Non-Monetary Value: Digital Goods have no cash or real-world value and cannot be redeemed for money, credit, or equivalents.
• Failed Transactions: If a purchase is not delivered due to technical issues, publisher failure, or transaction error, you must notify Volatil3 within 48 hours at [Support Email/Helpdesk]. Verified failed transactions may be refunded or re-delivered at Volatil3's discretion.
• Chargebacks & Disputes: Unauthorized or fraudulent chargebacks may result in account suspension, reversal of Digital Goods, recovery of amounts owed, and potential legal action.
• Refund Requests: Refunds (where permitted) will only be issued through the original payment method used at the time of purchase. Processing times may vary depending on the payment provider.
• Cancellation of Orders: Orders for Digital Goods are processed instantly and cannot be canceled once submitted, unless prevented by system failure or unavailability of goods.
• Company Discretion: Volatil3 reserves the right to grant or deny refund/cancellation requests on a case-by-case basis, in accordance with this EULA and applicable laws.

6. Intellectual Property

• All rights, titles, and interests in the Platform, Digital Goods, software, branding, and proprietary technology remain vested in Volatil3 or its licensors.
• You may not copy, distribute, create derivative works from, or exploit the Platform or Digital Goods without prior written consent.

7. Updates & Platform Changes

• Volatil3 may provide automatic updates, patches, or modifications to maintain functionality and security.
• Volatil3 reserves the right to modify, suspend, or discontinue parts of the Platform or Digital Goods without liability.

8. User Content & Code of Conduct

• Ownership: You retain ownership of User Content you submit.
• License to Volatil3: By posting content, you grant Volatil3 a worldwide, royalty-free, irrevocable license to use, reproduce, display, and distribute it.
• Prohibited Content: You may not post unlawful, offensive, defamatory, or infringing content.
• Community Standards: Users must engage respectfully. Harassment, hate speech, or abusive behavior may result in account suspension.
• Monitoring: Volatil3 reserves the right to review, remove, or restrict User Content at its discretion.

9. Disclaimers

• The Platform and Digital Goods are provided "as is" and "as available."
• Volatil3 disclaims all warranties, express or implied, including merchantability, fitness for purpose, and uninterrupted access.
• Volatil3 makes no guarantees that Digital Goods will remain available or that prices will not change.
• Third-party failures (payment processors, publishers, ISPs) are outside our responsibility.

10. Limitation of Liability

• To the maximum extent permitted by law, Volatil3 shall not be liable for indirect, incidental, or consequential damages, including loss of profits, data, goodwill, or Digital Goods.
• In no event shall Volatil3's total liability exceed the total amount paid by you in the three (3) months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Volatil3, its employees, officers, affiliates, and licensors against claims, damages, or costs arising from:

• Your use of the Platform or Digital Goods.
• Your breach of this EULA.
• Your violation of any law or third-party right.

12. Governing Law & Dispute Resolution

• This EULA shall be governed by and construed in accordance with the laws of India.
• Any disputes shall first be attempted to be resolved amicably through good-faith negotiation.
• If unresolved, disputes shall be referred to binding arbitration in Gujarat, under the Arbitration and Conciliation Act, 1996. The arbitration shall be conducted in English by a sole arbitrator appointed by Volatil3 Technologies.
• Subject to arbitration, the courts of Vadodara, Gujarat, India shall have exclusive jurisdiction over all disputes arising from this EULA.

13. Termination

• Volatil3 may suspend or terminate your account for violations of this EULA, fraud, or unlawful conduct.
• Upon termination, your license is revoked, and access to Digital Goods ceases.
• No refunds will be issued for terminated or suspended accounts.

14. Miscellaneous

• Modifications: Volatil3 may revise this EULA at any time. Continued use constitutes acceptance.
• Severability: If a clause is invalid, the rest remains enforceable.
• Force Majeure: Volatil3 is not liable for events beyond its control (natural disasters, cyberattacks, government actions).
• Assignment: Volatil3 may assign rights under this Agreement without restriction. You may not assign without written consent.
• No Waiver: Failure to enforce any provision shall not constitute a waiver.
• Survival: Sections on Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, and Governing Law survive termination.
• Entire Agreement: This EULA is the full agreement between you and Volatil3 regarding the Platform.
